J. Michael Hayes

J. Michael Hayes has been in private practice in Buffalo since his admission to the Bar in 1977. He was born in St. Louis, Missouri in 1946 and attended the University of Notre Dame and SUNY at Brockport graduating Summa Cum Laude in 1973. He attended the University of Buffalo Law School graduating in 1976 after achieving an award for excellence in the Senior Trial Technique Course. He is presently an adjunct professor at the University of Buffalo Law School where he teaches a course on Motor Vehicle Accidents.

J. Michael Hayes is a Board Certified Civil Trial Specialist who has spent his entire legal career representing and helping victims of accidents. He negotiates and takes to trial, where necessary, their personal injury claims against insurance companies. A sample of his results and a few of the verdicts he has taken are found in Awards.

Mr. Hayes is Board Certified by the National Board of Trial Advocates. The National Board of Trial Advocates is a National certifying organization for attorney specialization with rigorous standards. Members are required to be recommended by several Judges as well as other private practitioners before whom the attorney has actually tried cases to verdict. Applicants must take a national examination in the area of specialization, in Evidence and on Ethics. Recertification is required every five years and all recertification applications must contain additional personal references verifying competence in the field of trial work, professionalism and ethics.

Mr. Hayes is also a Charter Member of the Buffalo Chapter of the American Board of Trial Advocates. He is a member of the New York State Trial lawyers Association, The Association of Trial Lawyers of America, is listed in The Bar Register of Preeminent Lawyers, Who’s Who in America and Who’s Who in American Law.

Mr. Hayes is a frequent lecturer and has presented seminars for the New York State Bar Association and the National Institute for Trial Advocacy on trial technique, punitive damages, the Labor Law, assumption of risk, depositions and discovery. Additionally, he is the author of “New York Motor Vehicle Accidents”, a text published by James Publishing Company, 1999, two chapters in the text “Plaintiff’s Personal Injury Actions” published in March, 2008 by the New York State Bar Association, as well as articles in Statewide publications including the New York State Bar Journal and the New York State Trial Lawyers Association’s “Bill of Particulars”.

F. David Rusin

F. David Rusin is a native of Buffalo, New York, and was graduated from St. Joseph's Collegiate Institute in Kenmore, New York. Subsequently, Mr. Rusin obtained a Bachelor of Arts degree from the State University of New York at Buffalo, and a Juris Doctor degree from the University of Dayton School of Law, in Dayton, Ohio. While at the University of Dayton, he was appointed to the position of teaching assistant, and was selected to serve on the Moot Court Board for a two-year term. Mr. Rusin was also one of a select few students in his class to be licensed to practice law in the local courts during law school.

Mr. Rusin began his legal career with the Office of the Erie County Attorney, Erie County New York. In that office, he served as an Assistant Erie County Attorney, where he was a member of the litigation team and represented the County of Erie primarily in the defense of tort cases, and other types of legal matters as well.

After leaving the County, Mr. Rusin entered the arena of plaintiff practice, and joined James J. Moran, P.C., a law firm that concentrated in personal injury practice. Subsequent to his association with the Moran firm, Mr. Rusin was a founding member of Ballow, Braisted, O'Brien & Rusin P.C., a Buffalo law firm that concentrated its practice in the handling of personal injury litigation. In working on the defense side of litigation matters during his years with the County, and now focusing on the plaintiff side, Mr. Rusin has obtained invaluable insight into the workings of the "other side", and now draws on that experience to the advantage of his injured clients in pursuing their claims.

Mr. Rusin is a member of the Association of Trial Lawyers of America, the New York State Bar Association, the New York State Trial Lawyers Association, the Bar Association of Erie County, and the New York Trial Lawyers Association, Western Region Affiliate. Mr. Rusin is a frequent lecturer on a wide variety of legal topics. In addition to serving on various committees in several professional associations, Mr. Rusin is involved in various charitable organizations and serves as an advisor for high school mock trial teams.

Mr. Rusin is admitted to practice law in all the courts of the State of New York; the United States Supreme Court; the United States Court of Appeals; United States District Court, Northern and Western District of the New York; and the Western District of Kentucky.

Mr. Rusin resides in Williamsville, New York, with his wife Maureen and their daughters Alexa and Kyla.

Eric R. Ziobro

Eric R. Ziobro grew up in Lackawanna, New York, and graduated from St. Francis High School in Athol Springs, New York.  He subsequently attended Ithaca College, where he obtained a Bachelor of Arts in Biology.  While at Ithaca College, he was a member of the National Biological Honor Society, Beta Beta Beta, and a member of the Ithaca College Baseball Team.  After graduating from Ithaca College, Mr. Ziobro attended law school at the State University at Buffalo, School of Law, from which he graduated and received his Juris Doctor.

Over the past ten years, Mr. Ziobro has primarily practiced as a civil litigation attorney.  He has experience representing both plaintiffs and defendants, and the latter experience provides unique insight in prosecuting claims on behalf of seriously injured clients.  He has taken verdicts, settled cases, argued before the Appellate Division, Fourth Department, and obtained favorable results for his clients at arbitrations.

Mr. Ziobro is a member of the American Association for Justice (f/k/a Association of Trial Lawyers of America), the New York State Trial Lawyers Association, the Erie County Bar Association, and the New York State Trial Lawyers Association, Western Region Affiliate.

He and his wife, Julie, have been married since 2003, and they now live in Hamburg with their two children: Benjamin and Isabella. When he has a moment, he enjoys spending time with his family, and playing golf and softball.
