Two cars collided in an intersection, veered onto the sidewalk and struck a pedistrian, severing her leg. Street signels were timed such that while one car entered on a green light, the light changed and as he was still traveling through, another car on the intersecting street also had a green light and proceded into the intersection. A jury made an award in her favor and against the City that mistimed the lights. What did the New York Court of Appeals do? Did they confirm the woman's award for the clear negligence of the City? A surprise to all would be that Worker's Compensation may not have a lien on the recovery. Prior to Ahlborn, it had been held that the pain and suffering recovery included Worker's Compensation payments and they were repaid first. The US Supreme Court in Ahlborn would seem to create a question. This alternative that permits more of the recovery to go to the client should be explored and, if necessary, litigated!
