While it is claimed we are a "Nation of Laws", the emperical evidence would suggest that this premise is false. There appear to be "special entities" that are accorded relative immunity by the courts of New York though they carefully contrive to create the impression of equity, fairness and justice. The "protected" would include the State, Municipalities and Public Authorities.<br><br>What are your expriences and impressions?<br><br>

Did you know that most towns & villages have a "prior written notice" requirement before a claim may be made for a defective sidewalk? A sidewalk can be in bad repair or extremely elevated for years and if you are injured, there is no legal responsibility unless prior written notice was previously delivered to the Town or Village clerk.

The case of Weiss v Fote (1960) held that Ms. Fote would need to prove that there had been a "failure to review the municipal plan in light of its actual operation." Ms. Fote's verdict was thrown out. The back story is that Justice Stanley Fuld who was the author of the decision was concerned that New York City might be threatened fiscally if "experts" were permitted to criticize the City relative to intersection accidents. Now you know what may be the "rest of the story".

I found this post very interesting. It was very interesting how you worded it.
