J. Michael Hayes is bringing one of the potentially largest qui tam (whistleblower) lawsuits ever initiated in an attempt to recover billions of dollars for the Federal government. USA ex rel HAYES v ALLSTATE, et al., 12-CV-1015(S) It is alleged that liability insurers nationwide devised a “scheme” which permitted them to avoid repaying Medicare upon resolution of claims in lawsuits. They attempted (and succeeded) for many years to shift the burden of repayment to the injured victim, often a Medicare beneficiary. This lawsuit seeks to recover for the government and taxpayers those lost funds and, it would appear, that the government has no other recourse. If the suit does not succeed, the government forever loses those debts it is due.
