Before dawn on a cold winter morning, a young woman was walking into work. She slipped and fell on a large sheet of ice, literally created by Defendants who had intentionally discharged water from an interior sprinkler system outside onto the a Mall parking lot. There had been no recent precipitation. The roads and parking lots were dry and clear. the woman suffered fractures to her left ankle which healed very well leaving her with very few limitations.
Since the Mall and the maintenance crew had created the ice on the parking lot, it was determined by Summary Judgment that they were responsible. Their insurance carriers agreed to the out of court settlement of $440,000.
